Anthropic this month sued the Pentagon after the department designated the company as a “supply chain risk,” a label Anthropic says is usually reserved for foreign adversaries and that it argues was imposed unlawfully. According to Forbes, CBS News, Al Jazeera, Wired and PBS, the company’s federal complaint contends the designation exceeds the Pentagon’s authority and violates its constitutional rights, including the First Amendment. Anthropic says the action followed its refusal during February contract talks to permit use of its models for autonomous weapon systems or domestic mass surveillance; the Pentagon, by contrast, maintains it must retain the ability to deploy contractor technology for any lawful purpose.
The dispute is consequential financially as well as legally. Industry reporting notes the award at issue could be worth up to $200 million to Anthropic, while the supply-chain-risk tag may force other government contractors that work with the Pentagon to demonstrate they did not rely on Anthropic models in defence-related work, potentially disrupting existing commercial relationships and future deals.
The friction unfolded against a broader Pentagon effort to accelerate AI adoption. The department in January published an AI Acceleration Strategy aimed at embedding machine learning and generative tools across its mission sets by reducing bureaucratic barriers, expanding experimentation and delivering a handful of “pace-setting” projects intended to build essential data and infrastructure. Among the initiatives named are a programme to explore swarm tactics and counter-AI approaches, an intelligence-focused effort designed to shrink the time from collection to operational use, and an enterprise GenAI capability to give the department’s personnel controlled access to advanced models across classification levels.
While Anthropic and the Pentagon spar in court, the department has moved forward with other vendor relationships. According to The Hill, the Pentagon reached an agreement with OpenAI to allow use of the company’s models on classified systems, with both sides agreeing that the technology will not be used for autonomous weapons or local mass-surveillance programs. OpenAI’s chief executive framed the outcome as preferable to protracted legal escalations: “We have expressed our strong desire to see things de-escalate away from legal and governmental actions and towards reasonable agreements,” said Sam Altman, OpenAI CEO.
The litigation over usage restrictions highlights a recurring procurement dilemma: how to reconcile vendor-imposed ethical or safety limitations with the government’s need to reserve broad operational options. Legal analysts cited in reporting argue the case could set precedent on whether private firms may contractually limit downstream government uses of dual‑use technologies, or whether such restrictions run afoul of the government’s ability to acquire capabilities for “all lawful uses.”
At the same time, the Army and other services are experimenting with AI to streamline acquisition workflows and hasten delivery of new systems. Service programmes tested in recent months include AI prototypes intended to compress the time required to assemble Acquisition Requirement Packages from many weeks to hours or minutes, tackling lengthy, error-prone documentation that has delayed solicitations and awards. Officials say early pilots produced two supply-type awards in fiscal 2025 and that the prototypes are being evaluated for broader procurement uses.
Private-sector innovation is also being tapped for operational needs. Reporting shows the DOW’s chief digital and AI office, together with Central Command, awarded an other-transaction agreement to Raft for its AI Mission System, a containerised agentic platform designed to let operators train, evaluate and field computer-vision models without a data‑science background. The company said the system addresses use cases such as broad-area satellite search, distributed monitoring and counter-uncrewed-air-system detection. “This wasn’t about building another tool,” said Shubhi Mishra, Raft founder and CEO. “This was about rethinking how AI gets built for mission-critical environments and how we empower operators to adapt when the mission demands it.”
The Anthropic case will be watched closely by defence contractors, technology firms and procurement officials. If courts uphold the Pentagon’s designation, vendors may face new compliance burdens and reputational costs when bidding on defence work; if the designation is reversed, private firms could assert greater authority to constrain how their technologies are used, reshaping contract negotiation dynamics. Either result is likely to influence how the Pentagon writes contracts for emerging technologies and how companies approach offers of additional ethical or safety controls.
Officials and industry participants are preparing for that debate to unfold in public forums. The Potomac Officers Club’s March 18 Artificial Intelligence Summit, for example, has been billed as an opportunity to hear department leaders outline contracting approaches and to discuss operationalising vetted, decision‑ready AI through partnerships between government and industry.
As the litigation proceeds, the broader policy question remains unresolved: how to balance operational flexibility for national defence with safeguards against misuse of powerful AI systems. The outcome of the Anthropic‑Pentagon dispute could therefore shape not only a single contract but the contours of future partnerships between the US military and commercial AI developers.
